Terms of Use

1. About the service

LISTAI is a workspace for style professionals: saving products from online stores, keeping a library and composing looks. The service is provided by SERHII TYTARENKO, a sole trader (entrepreneur individuel) registered in France, SIREN 102 719 770, address: 129 Allée Mériel, 83700 Saint-Raphaël, France; trading as LIS Solutions. The service is in early access: its functionality may change and grow.

2. Account

You sign in with a one-time code sent to your email address. You are responsible for keeping access to your mailbox secure, and for actions taken in your account.

3. Acceptable use

The service may be used only lawfully and for its intended purpose. Attempts to disrupt the service, to reach other people's data, or to extract data from the service itself in an automated bulk fashion are prohibited.

4. User content and responsibility

LISTAI is a tool. Everything in your workspace — the data and images saved from store pages, and screenshots in particular — is created by your explicit action: the service performs no autonomous bulk crawling or scraping of websites; extraction of a specific product is always initiated by you. We store such material privately, on your behalf, for your professional use.

By using the service you confirm and warrant that:

• you save material for your own professional work (selecting and presenting products to clients) and are responsible for respecting third-party rights — including stores' and brands' rights in their images and content — and the terms of use of the sites concerned;
• when adding your clients' data you have the necessary basis for doing so;
• you do not use the service to copy, republish or distribute other people's content in bulk.

5. Rights in content

Your content remains yours. You grant us a limited licence to store, process and display it — solely in order to operate the service. The LISTAI platform, its code, design and brand belong to us.

6. Rights-holder notices

If you believe that material held in the service infringes your rights, write to contact@listai.style describing the material and evidencing your rights — we will consider the notice and, where it is well-founded, remove the material.

7. Early access and no warranty

The service is provided "as is". We aim for reliable operation, but during early access we do not guarantee availability or data durability at a commercial SLA level, and we may change or suspend features. We recommend not using the service as the only store of critical material.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect losses, lost profits or loss of data. Consumer rights that cannot be limited by law are unaffected.

9. Termination

You may stop using the service and request deletion of your account at any time. We may suspend or close an account for a material breach of these terms, giving you notice where it is reasonably possible.

10. Processing of client data (data processing terms — DPA)

When you add your clients' personal data to the service, you act as the controller of that data and we act as the processor within the meaning of Article 28 GDPR. This section constitutes the data processing agreement between you and us and applies automatically on use of the service:

• Subject matter and duration: storage and processing of your clients' data in your workspace for as long as your account is active.
• Nature and purpose: providing the features of the service — client records, selections and looks.
• Categories of data and data subjects: information about your clients that you choose to add (name, contact details, photographs, measurements); the data subjects are your clients.
• Our obligations: to process such data only in order to provide the service to you and in accordance with your actions within it; to ensure confidentiality and technical security measures (Article 32 GDPR); to engage only the sub-processors listed in section 8 of the Privacy Policy, notifying you of changes to that list; to assist you in responding to data subject requests; to notify you without undue delay of data incidents that come to our attention; and to delete the data when the account is deleted (section 10 of the Policy).
• Demonstrating compliance: on request we will provide the information reasonably necessary to demonstrate compliance with these obligations.

11. Governing law

These terms are governed by French law. Disputes are subject to the competent courts of France; mandatory consumer rights in your EU country of residence are preserved.
